Abstract

This paper analyzes the legitimacy that the judges have, in a diffuse control system like the Argentine one, for the exercise of constitutional control. Criticisms of this democratic legitimacy and how they are overcome when the system meets certain requirements are analyzed. It also analyzes the need, at least in these latitudes, for an adequate control system to avoid overflowing of political bodies.
