The ex officio constitutional control in Argentina

Abstract

When there is talk of exerting control of constitutionality of office by judges, there is no reference to the possibility that a magistrate, without presentation of any part, for the mere knowledge of the existence of a rule apparently violating the Constitution national, may declare his disability in the absence of a real process. Both doctrinally and jurisprudentially there is agreement that this power is forbidden.
